Slip-And-Falls And Other Premises Liability Cases

We have all slipped or tripped and fallen. As children, we put a bandage on our wound and just went back out to play. No big deal, right? But sometimes it’s more complicated than that. Negligence by others can sometimes lead to serious injuries.

For example, a property owner has a hole on the property that is hard to see. The property owner hasn’t done anything to repair the hole or make sure people can see it. You are on the property legally and fall in the hole and break your leg. You incur significant medical expenses and aren’t able to work for six weeks as a result of the fall.

The court may well determine fault on the part of the property owner, if the evidence is presented properly.

Many types of dangerous situations can result in slip-and-fall accidents. Wells Law Group, P.A., in Tampa, Florida, has extensive experience handling a range of personal injury claims, including slip-and-fall cases. We strive to maximize injured clients’ recoveries and we may be able to do the same for you. Find out with a free case review.

How Do I Know If I Have A Slip-And-Fall Case Or Need An Attorney?

Many people are injured every year in slip-and-fall cases. Sometimes, these are caused by negligence, but often they are not. If you have been injured in a slip or fall, ask yourself the following questions about your responsibility:

  • Could you have been more careful?
  • Were you being silly, running, or acting inappropriate for the conditions, which led to your slip or fall?
  • Did you ignore warnings that the area could be dangerous?
  • Did you have a legitimate reason for being in that area?

Questions About Owner Liability:

  • Could the accident have been prevented?
  • Does what you tripped over serve a useful purpose?
  • Could what you tripped over have been marked more clearly to increase safety?
  • Did poor or broken lighting contribute to the accident?
  • Does the owner have a regular maintenance routine?

Accidents happen for a variety of reasons and can result in serious or even catastrophic injuries, such as brain trauma or spinal cord injuries. Every year, people die as a result of a slip-and-fall.

What To Do After A Slip-And-Fall Accident On Commercial Property:

  • Take photos of the location and what caused the slip-and-fall.
  • Tell an employee.
  • Get the employee to do an incident report.
  • Get a copy of the incident report.
  • Ask the employee to preserve video of the area.
  • Get witnesses’ names, addresses and phone numbers.
  • Look for signs of the condition being there for awhile:
    1. Footprints
    2. Drying of edges (if you slipped on a liquid)
    3. Other spills/signs of spills in the area
